Terms & Conditions

Welcome to Pixel This Marketing. By using our services, submitting payment, or engaging with our proposals, you agree to be bound by the following Terms and Conditions. Please read them carefully.

 


 

1. Acceptance of Terms Through Payment

By paying any invoice issued by Pixel This Marketing — especially invoices that reference or are accompanied by a proposal — you agree to be bound by our Terms and Conditions and Privacy Policy.
Payment, whether completed manually by you, by our team, or via auto-pay setup by either party, will serve as a legally binding agreement and substitute for a physical signature.

 


 

2. Scope of Services & Retainers

All services are defined by the scope outlined in your most recent proposal or statement of work.

  • Monthly Contracts: All service agreements are month-to-month unless otherwise stated. We require a 60-day written cancellation notice to terminate services. During this period, we will:

    • Complete active tasks or projects

    • Support a smooth offboarding/transition

Clients will be invoiced in full for the 60-day period, regardless of active workload. If the project or service requirements exceed this window, additional work will be billed at $150/hour.

  • Discovery & Enablement Fee: All retainers and project engagements include a one-time discovery and enablement fee starting at $349. This may increase based on complexity, urgency, escalated tickets, or client-side delays in communication or approvals.

 

 

3. Payment Terms & Charge Disputes

Payment is due upon receipt unless otherwise agreed in writing. We accept various forms of payment, including ACH, card, and invoicing platforms.

  • Chargebacks & Disputes: Any unauthorized chargebacks or disputes made under false pretenses will be considered a breach of contract. Pixel This Marketing reserves the right to charge a $50,000 dispute penalty and recover legal and administrative costs. We strongly encourage direct communication to resolve any concerns before initiating a dispute.

 

 

4. Intellectual Property

  • Pixel This Marketing retains ownership of all working files, drafts, and raw design elements unless explicitly transferred in writing. Final deliverables, once paid in full, may be used by the client in accordance with the agreed scope.

  • We reserve the right to showcase completed work in our portfolio unless a confidentiality clause was signed beforehand.

 

 

5. Graphic Design for Retainer Clients

Retainer clients receive complimentary graphic design as part of their agreement. The following applies:

  • Only one active design request at a time will be accepted.

  • Designs must be related to your business marketing needs.

  • This service is a courtesy benefit of being a retainer client and is not itemized or separately billed unless agreed upon.

 

 

6. Client Responsibilities

Clients agree to:

  • Respond to project-related communication in a timely manner.

  • Provide all necessary assets, credentials, and approvals to enable project progress.

  • Understand that delays in communication or approval may result in additional fees or timeline extensions.

 

 

7. Limitation of Liability

Pixel This Marketing shall not be liable for:

  • Losses or damages resulting from the client’s failure to implement marketing suggestions, third-party platform issues, or late approvals.

  • Any indirect, incidental, or consequential damages arising from the use of our services.

Our maximum liability under any agreement shall not exceed the total fees paid by the client in the 30 days prior to the incident in question.

 


 

8. Confidentiality

Both parties agree to keep confidential all non-public information, materials, or strategies exchanged during the course of the engagement.

 


 

9. Non-Disparagement

You agree not to publicly defame or disparage Pixel This Marketing or its employees, partners, or affiliates in any manner likely to harm its reputation. We commit to the same.

 


 

10. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia. Any disputes will be resolved in a court of competent jurisdiction located in or near Fairfax County, VA.

 


 

11. Updates to Terms

We may update these Terms & Conditions from time to time. Clients will be notified of material changes, and continued use of services after notification constitutes acceptance of the revised terms.
